Chapter 1 Cases

Trump v. Chicago Tribune Company

Donald Trump brought forth a libel action suit against the Chicago Tribune Company and Paul Gapp. This case is an example of common law procedures and is a judge-made law whereas it is up to the judge on deciding as to whether the lawsuit should be dismissed or not that was filed by Trump. This case follows the precedent of the libel law while the courts found statements concerning the Tribune article where there were expressions of opinion that criticized Trump and his ideas of building the tallest building on a landfill site. The judge dismissed the complaint in court stating the case was based merely on opinions.

Wisconsin v. Torbeck

Every state in the U.S. has laws that prohibit driving while under the influence of alcohol. However, one evening Torbeck was cited by Deputy Putzer for operating a vehicle while under the influence given the notation that the defendant had ‘huffed’ before operating the vehicle and this was a violation in the state of Wisconsin. This case illustrates a statutory law concerning the difficulties that exist in applying a statute to a known problem. Statutory law refers to the law that the government makes and with this case, the court agreed with Torbeck that such legislation was not including the DFE as an intoxicant while dismissing the charges against Torbeck.
